Governor Cuomo has asked for an investigation into reports of wage and hour abuses in the nail salon industry. Where hourly wages were paid, they were often understated. Flat rates were often found, per day or per week. This would violate the overtime provisions of the Fair Labor Standards Act (FLSA).
The workers are often vulnerable, preferring to work “off the books”, since many appear to be undocumented. Unfortunately, these workers are built-in victims of wage and hour violations.
